Terms of use

The following terms and conditions of use (hereinafter referred to as "T&C") aim to determine the rules for using the "CareMyShop" service (hereinafter referred to as "CareMyShop") published by the company Profileo (hereinafter referred to as "Profileo").

By using the CareMyShop site on your device, by installing its monitoring tool on your PrestaShop store and/or accessing its management interface, as a user, you unconditionally accept all the T&C defined below. If you do not wish to accept these T&C, we kindly ask you not to subscribe or use this service.

Any use of CareMyShop must comply with these T&C.
 

Article 1. DEFINITIONS

Terms beginning with a capital letter in these T&C, whether used in the singular or plural, shall have the meaning given to them below:
«User» or «You» means a natural person, of legal age or a minor who has previously obtained the authorization of their parents or the person vested with parental authority, and who has subscribed to the CareMyShop service for their own needs, within the framework of strictly professional use.
«CareMyShop» means the service edited and provided by Profileo, giving access to the supervision tool of an e-commerce store as well as the functionalities related to it. This also includes contents, software, programs, tools (programming, browsing, etc.), databases, operating systems, documentation and all other elements and services that compose it, updates and new versions that may be brought to CareMyShop by Profileo.

  

Article 2. PURPOSE AND FUNCTIONALITIES OF CareMyShop

The CareMyShop service and/or interface aims to allow merchants to verify the proper functioning of their own e-commerce store.
Thus, CareMyShop allows users:
To analyze the proper design of their e-commerce store
To control its technical performance
To check for known security vulnerabilities (CVE)
To propose technical resolution responses
This list is non-exhaustive and may be modified at any time by Profileo without its liability being engaged at this title by anyone.

 

Article 3. ACCESS TO CareMyShop

To access and use CareMyShop, you must have a computer or smartphone and access to the Internet.

Access to CareMyShop can be done either directly from a dedicated URL or from a mobile PWA application.

Due to its nature, access to CareMyShop and its use requires the installation of an additional tool (PrestaShop module) on your store and the input of various technical information in its management interface.

 

Article 4. FINANCIAL CONDITIONS

CareMyShop is offered as a subscription service, excluding subscription costs from the mobile operator, connection and internet access costs, any additional costs for loading data, and subscription costs for supplementary services offered and provided by Profileo or other third-party companies.

 

Article 5. INTELLECTUAL PROPERTY OF CAREMYSHOP

The entirety of the content of the application is subject to French, European, and international legislation on copyright and intellectual property. All reproduction and representation rights related to CareMyShop are reserved by Profileo, including all graphic, iconographic, and photographic representations, regardless of the territory of protection and whether or not these rights have been registered. The reproduction and/or representation of all or part of CareMyShop, whatever the medium, including all trade names, trademarks, logos, computer codes, domain names, and other distinctive signs, is strictly prohibited and constitutes an infringement sanctioned by the intellectual property code.

Without prejudice to the provisions of Article 5, none of the provisions of the T&Cs may be interpreted as a transfer, sale, concession, license, loan, rental, or direct or indirect authorization of exploitation granted by Profileo to the User concerning the application, its content, and/or its operation.

 

Article 6. USE LICENSE

Profileo grants the User a personal right to use CareMyShop, the Content, and the Services, which is non-exclusive, revocable, non-transferable, and worldwide only for its own needs within the framework of the use of CareMyShop and the Services, excluding any other purpose.

The User is strictly prohibited from accessing and/or using the source code of CareMyShop and/or the software components of CareMyShop.

The User acquires no intellectual property rights over CareMyShop, the Content, and/or the Services or any other rights than those conferred by these T&Cs.

The User expressly undertakes that the use of CareMyShop will not in any way infringe Profileo's rights, and in particular that such use will not constitute an act of counterfeiting, unfair competition, or parasitism of the Content.

 

Article 7. USER OBLIGATIONS

The User undertakes expressly:

- to use CareMyShop on its equipment exclusively for professional use;

- not to reproduce CareMyShop, in whole or in part, permanently or temporarily, by any means and in any form;

- not to use software or processes intended to copy the Content without the prior written authorization of Profileo;

- not to carry out any adaptation, modification, translation, transcription, arrangement, compilation, decompilation, assembly, disassembly, transcoding, or apply reverse engineering of the application, the Content, or the Services, in whole or in part.

 

Article 8. PROTECTION OF PERSONAL AND TECHNICAL DATA

Any personal data related to the e-commerce store that may be collected through the use of CareMyShop will be processed and stored in accordance with french Law No. 78-017 of January 6, 1978, as amended, relating to Information Technology, Files, and Liberties.

Refusal to provide certain personal data related to the creation and management of the e-commerce store may deprive you of access to certain Services.
Profileo reserves the right to use the data collected by the CareMyShop service to offer targeted solutions and services to users' needs.
In the event of communication of personal data, you have the right to direct access, rectification and opposition of the data that concerns you. You can exercise this right by simply contacting zentria@profileo.com

  

Article 9. AVAILABILITY OF CAREMYSHOP

Profileo undertakes to make its best efforts to secure access, consultation, and use of CareMyShop Services. CareMyShop is accessible 24 hours a day, 7 days a week, except in cases of force majeure or the occurrence of an event beyond Profileo's control and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of CareMyShop. Maintenance interventions may be carried out without prior notice to Users.

Profileo does not offer any continuity of service guarantee and cannot be held responsible in the event of temporary inability to access all or part of CareMyShop.

No right to compensation is granted under this paragraph. Profileo reserves the right to cease, without notice, without compensation and at its sole discretion, definitively or temporarily, to provide all or part of the Service or CareMyShop functionalities.

 

Article 10. WARRANTY LIMITATION

Access to and use of CareMyShop are at the User's own risk.

CareMyShop and the software are provided "as it is" and "as available" without any warranty whatsoever.

It is the responsibility of each User to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack.

The User acknowledges and accepts the characteristics and limitations of the Internet network, including the functional characteristics and technical performance of the Internet network; connection and/or access problems to the Internet network and/or websites; network availability and congestion problems; network failure or saturation problems; transit time problems; access to online information, response times to display, consult, query or otherwise transfer data; risks of interruption; lack of protection of certain data against possible diversion or hacking; risks of contamination by any viruses circulating on the said networks, etc., for which Profileo's responsibility cannot be engaged.

Profileo cannot be held responsible:

- in case of defect, loss, delay, or error in the transmission of data that is independent of its will;

- for sending messages and/or data to a false, incorrect or incomplete address;

- if data did not reach it, for whatever reason, or if the data it receives is unreadable or impossible to process;

- if, for whatever reason, the User is unable to access or use the Site, CareMyShop, and/or the Services;

- if, for any reason, the connection should be interrupted.

- for the non-respect of the commitments of the users of CareMyShop towards their customers

Furthermore, Profileo disclaims all liability in the event of misuse of the terminal and/or incident related to the use of the terminal when using CareMyShop. Profileo cannot be held responsible in any way for any damage of any nature whatsoever caused to Users, their terminals, computer and telephone equipment, and the data stored therein, nor for any consequences that may arise from their personal, professional, or commercial activities.

 

Article 11. EVOLUTION OF GENERAL TERMS OF USE

The applicable terms of use are those in force at the date of connection and use of the service by the User.

Profileo reserves the right to modify, at any time, all or part of the provisions of the terms of use without notice or prior information to Users in order to adapt them to the evolution of Services, technical, legal or jurisprudential developments or when implementing new services.

Any modifications made by Profileo to the terms of use will be brought to the attention of Users by simply posting them online. They are deemed accepted without reservation by any User who accesses CareMyShop after said posting. Furthermore, Profileo therefore invites every User to regularly consult the terms of use.

Any new service incorporating new techniques or new features improving the quality of existing services will also be subject to these terms of use, unless expressly stated otherwise.

 

ARTICLE 12. APPLICABLE LAW AND DISPUTES

These terms of use are subject to French law. In case of dispute, and failing an amicable agreement between the parties, jurisdiction is given to the competent French courts of the city of Aix-en-Provence.
